Terms and Conditions of Use

1. Eligibility

You must be at least 18 years of age to create an account or use the Services. By using AdopterPassport, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. We do not knowingly collect personal information from individuals under 18.

2. Account Registration and Security

To use certain features of the Platform, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information during the registration process
• Maintain and promptly update your account information to keep it accurate and complete
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or incomplete, or if we reasonably believe your account has been compromised.

3. Collection and Use of Personal Information

AdopterPassport collects personally identifiable information (“PII”) to facilitate the adoption verification process and to connect adopters with rescue organizations. The categories of PII we may collect include:

• Identity Information: Full name, date of birth, government-issued identification details
• Contact Information: Email address, phone number, mailing address
• Housing Information: Type of residence, homeownership or rental status, landlord contact details (if applicable), pet policies at your residence
• Household Information: Number of household members, ages of children in the home, existing pets
• Veterinary References: Veterinarian name and contact information, pet care history
• Adoption History: Previous adoption records, surrender history, adoption outcomes
• Device and Usage Data: IP address, browser type, operating system, pages visited, and interaction data

We use this information to create and maintain your verified adopter profile, share relevant profile information with participating rescue organizations, facilitate the pet adoption process, improve the Platform, and communicate with you about your account and adoption opportunities.

4. Profile Sharing with Rescue Organizations

By creating an AdopterPassport profile, you acknowledge and consent to the following:

• Your verified profile information will be shared with rescue organizations and shelters that participate in the AdopterPassport network when you apply to adopt an animal or when you authorize such sharing
• Rescue organizations may use your profile information solely for the purpose of evaluating your adoption application
• We do not control the independent decisions of rescue organizations regarding adoption approvals or denials

You may withdraw your consent to profile sharing at any time by deactivating your profile through your account settings. Withdrawal of consent does not affect the lawfulness of sharing that occurred prior to withdrawal.

5. Data Retention and Deletion

We retain your personal information for as long as your account is active or as needed to provide you with the Services. You may request deletion of your account and associated personal information at any time by contacting us at support@adopterpassport.com or through the account settings in the Platform.

Upon receiving a verified deletion request, we will permanently delete your personal information within ninety (90) days, except where retention is required by applicable law or for legitimate business purposes such as fraud prevention or legal compliance.

6. Data Security

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect and store. These measures include encryption of data in transit and at rest, access controls, regular security assessments, and employee training.

However, no method of electronic transmission or storage is 100% secure. While we strive to protect your personal information, we cannot guarantee its absolute security. You acknowledge and accept this inherent risk when using the Platform.

7. User Conduct

You agree not to use the Services for any purpose that is unlawful or prohibited by these Terms. Specifically, you agree not to:

• Provide false, misleading, or fraudulent information in your adopter profile
• Misrepresent your identity, living situation, or pet care history
• Use the Platform for any commercial purpose unrelated to pet adoption
• Attempt to access another user's account or any non-public areas of the Platform
• Upload or transmit viruses, malware, or other harmful code
• Scrape, harvest, or collect data from the Platform through automated means
• Interfere with the proper functioning of the Platform

Violations of this section may result in immediate suspension or termination of your account, at our sole discretion.

8. Intellectual Property

All content, features, and functionality of the Platform are the exclusive property of Organize my Health LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in connection with pet adoption. You may not copy, modify, distribute, sell, or create derivative works based on the Platform or its content without our prior written consent.

9. Third-Party Services and Links

The Platform may contain links to third-party websites, services, or applications that are not owned or controlled by Organize my Health. We are not responsible for the content, privacy practices, or terms of use of any third-party services.

10. Communications and Notifications

By creating an account, you consent to receive electronic communications from us, including email notifications, in-app messages, and SMS messages related to your account, adoption applications, and Platform updates. You may opt out of non-essential communications at any time through your account settings.

11. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ORGANIZE MY HEALTH DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AdopterPassport does not guarantee that any adoption application will be approved. We do not evaluate, endorse, or guarantee the suitability of any animal for adoption.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ORGANIZE MY HEALTH LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

IN NO EVENT SHALL ORGANIZE MY HEALTH'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF FIFTY DOLLARS ($50.00) OR THE AMOUNT YOU HAVE PAID TO ORGANIZE MY HEALTH IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Organize my Health LLC, its officers, members, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses arising out of or relating to your use of the Services, your violation of these Terms, or any content you submit through the Platform.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us or through your account settings.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within thirty (30) days, either party may bring a claim in the state or federal courts located in Miami-Dade County, Florida.

16. General Provisions

• Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Organize my Health with respect to the Services.
• Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
• Waiver. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
• Modifications. We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a notice on the Platform.
